Description 

Confidentiality and Library Records:  What are the Rules?

 

This 2 hour program is designed to introduce the NJ Library Confidentiality Law and discuss how this law is applied in our libraries.  Attendees are encouraged to bring examples of local policies and procedures and join in the discussion about the real life situations that can make it difficult to uphold this vital law.  We will also discuss the USA PATRIOT Act and its impact on requests for library records. 

 

We will try to answer the following questions:

 

1.       What does the NJ Library Confidentiality Law say?

2.       What is a library record?

3.       What are the elements of a good confidentiality policy?

4.       What kind of procedures should a library have in place to deal with requests for library records?

5.       What are the common instances where records might be requested?

6.       What impact does the USA PATRIOT Act have on the NJ Library Confidentiality Law?

7.       What is a FISA Court?  National Security letter?
